Terms & Conditions of Access

Great Dane LLC (“Great Dane”) is in the business of, among other things, manufacturing and repairing truck bodies, dry van trailers, refrigerated trailers and platform trailers. These terms and conditions govern access to and use of Great Dane’s Learning Management System (“LMS”), formally documented programs (“Programs”), certifications (“Certifications”), training , examinations and/or evaluations, resources, videos, files, links and any other information or materials not otherwise mentioned here (“Materials”); collectively called Content (“Content”); in either digital or print form.


“Users” should read carefully the following terms and conditions. Great Dane will only grant access to, and use of the Content if you accept and agree to all of the terms and conditions contained herein.


Great Dane may change the terms and conditions at its own discretion.

Privacy Policy

This policy describes what information is collected and how that information is used. Because this privacy policy only applies to Great Dane Content, you should examine the privacy policy of any website that you access using Great Dane Content.


Personal Information:


When you register an account in this system, you may be required to provide Great Dane with some personal information, including your name, employer and contact information.


This information may be used for the following purposes:

  • manage your access to Content;
  • maintain a record of the LMS programs, evaluations, courses, resources or orientations you accessed and completed;
  • communicate with you in a timely and efficient manner: For example, to send automated email reminders for course completion or to email scheduled reports for reasons including retraining and updating certifications. Emails are used for system communication on tasks, instructor-student communication, notification of upcoming courses, new registrations, course completion and functional items such as password recovery;
  • perform automated actions such as subscription to a course based on individual qualifications, other courses complete, department or geographic location. As such information such as location, and previous education or qualification may be requested to accurate organize your training and provide automated rules guidelines on how to plan success training for you as an individual;
  • analyze business results in the form of reporting on course completion, user progress towards training objective, competency management, etc. This information is only provided to authenticated administrators of the system. Administrators have the ability to share this information with other non-authenticated users by exporting reports;
  • act as required or authorized by law.


Great Dane managers, supervisors, training coordinators and administrative staff, as well as representatives from Great Dane Organizational Learning, may have access to the information you provide and it may be disclosed to your employer upon request. Great Dane will not provide these personal details otherwise except as otherwise required by law.


By registering, and providing your personal information, on this system, you consent to Great Dane’s collection, use and disclosure of your personal information, as listed above, as well as for other reasonable purposes.

Cookies:


Cookies are simple text files stored on your web browser to provide a means of distinguishing among users of this LMS. The use of cookies is a standard practice among Internet websites.


Session cookies – These are created automatically on the device you use to access this LMS. We may use this cookie feature to store a randomly generated identifying tag on the device you use to access this LMS. A session cookie is erased during operation of your browser or when your browser is closed.


Persistent cookies – These are more permanent and can be re-read when you return to the site that placed them on your computer. The information in them is written onto your hard drive and remains there until the expiry date of the cookie. They allow the website to recognize you when you visit again and tailor the information presented to you based on your needs and interests.


The software and hardware you use to access the website allows you to refuse new cookies or delete existing cookies. Refusing or deleting these cookies may limit your ability to take advantage of some features of this website.

Information Security:


All information is controlled through secured username and password based access. All activities on the administration side of the system are audited and logged to provide the ability to accurately track the creators of content and how all information is reported against and exported. To maintain your security, we encrypt all user passwords and have no ability to retrieve user generated password information. Secure HTTPS connections are used to better secure your information throughout the system.


We do not sell or rent customer information to anyone. Nor do we share customer information with organizations outside of our relationship with you that would use it to contact you about their own products or services.

LMS & Content Disclaimer

Great Dane may change information at any time without notice. Content is provided “as is” and Great Dane disclaims all express or implied warranties arising from any course of dealing, usage or trade practice of this service.


While care has been taken in the preparation of Content, Great Dane and any other Content provider do not guarantee that any licensing or registration requirements specified here are either complete or up-to-date for your State or region. Great Dane does not accept any liability for any damage or loss (including direct, indirect and consequential loss) incurred by any person as a result of relying on the information contained in the Content.

Content including videos, documents, e-learning, resources and other information provided by Great Dane; are furnished by Great Dane as a guide to general practices in the manufacture, repair and maintenance of truck bodies and truck trailers. Please note that the scope of this Content is not exhaustive of all general practices. There may exist certain general practices that do not appear in Content. Moreover, various Content assume that its user will have a baseline level of competence in the area of truck trailer and/or truck body assembly, maintenance or repair.


The Content represents the state-of-the-art that existed at the time of its preparation. Users of Content should familiarize themselves with any advancements in practices that have occurred subsequent to the publication date.


Great Dane has not undertaken an evaluation of all the conceivable ways in which Content such as these may be used or the consequences of such uses. Great Dane Employees:

Users include Great Dane Employees. This LMS includes Great Dane resources, training and evaluations relevant to your employee status and is required by Great Dane. The information, resources and training contained within this site in no way displace or replace training or policy or any other lawful requirement of Great Dane, and are additional to any requirements set forth by Great Dane.


The resources and files on this LMS are intended for training and evaluation of Great Dane employees. Use of the system includes access and requirements to resources, training, performance scores, and marks, records of attendance or activity completion for various courses, certificates, programs, and evaluations and other such materials or tests that Great Dane requires for safety of the employee. Attendance and successful completion of each or any of these may be required as a part of gaining or maintaining employee status.


Great Dane is not obliged in any way to ensure that you complete or meet any requirements set out as either a part of this LMS or any other program that Great Dane may have in place. Great Dane reserves the right to modify employee status based on data collected from this site and other sources at their discretion.


Great Dane uses records from this site and other sources to:

  • determine status as an employee,
  • determine best fit for employees with various Great Dane departments, stations or work requirements,
  • provide records to indicate employee training,
  • evaluate performance for employees

Great Dane may use information collected on this system to evaluate or as a part of employment applications by employees for positions within Great Dane; and as a basis for making an employment offer to selected employees for positions within Great Dane.


Completion of training, courses or any other criteria in this system do not assure, promise or guarantee any employee or applicant or any individual a continued position working as an employee of Great Dane in any way, and shall not constitute an assurance, promise or guarantee of promotion, positive performance review or any other benefit.

Great Dane Temporary Workers


This section applies to Great Dane Temporary Workers only.


Users may include Great Dane Temporary Workers. This LMS includes Great Dane resources, training and evaluations relevant to your temporary worker status and is required by Great Dane. This LMS does not include information regarding your employer in any form. The information, resources and training contained within this site in no way displace or replace training or policy or any other lawful requirement of your employer, and are additional to any requirements set forth by your employer.


The resources and files on this site are intended for training and evaluation of Great Dane temporary employees and temporary employee applicants. Use of the system includes access and requirements to resources, training, performance scores, and marks, records of attendance or activity completion for various courses, certificates, programs, and evaluations and other such materials or tests that Great Dane requires for safety of the temporary employee and Great Dane employees. Attendance and successful completion of each or any of these may be required as a part of gaining or maintaining a temporary employee status.


Great Dane is not obliged in any way to ensure that you complete or meet any requirements set out as either a part of this LMS or any other program that Great Dane may have in place. Great Dane reserves the right to modify temporary employee status based on data collected from this site and other sources at their discretion.


Great Dane uses records from this site and other sources to:

  • determine application status as a temporary employee,
  • determine best fit for temporary employees with various Great Dane departments, stations or work requirements,
  • provide records to indicate temporary employee training,
  • evaluate performance for temporary employees

Great Dane may use information collected on this system to evaluate or as a part of employment applications by temporary employees for positions within Great Dane; and as a basis for making an employment offer to selected temporary employees for positions within Great Dane.


Completion of training, courses or any other criteria in this system do not assure, promise or guarantee any employee or applicant or any individual a continued position working as a temporary employee of Great Dane in any way, and shall not constitute an assurance, promise or guarantee of offer of permanent employment, promotion, positive performance review or any other benefit.


Registration and access:


Registration and access on this system may be closed after either:

  • termination or abandonment,
  • 10 days of inactivity or
  • 90 days from registration.

Data and records on this system will be maintained indefinitely.


Should you require access to account information after the account has been closed you will need to contact the site administrator and provide sufficient details to prove ownership of the account. Great Dane reserves the right to delete user records.


By registering, and providing your personal information, on this system, you consent to Great Dane’s collection, use and disclosure of your training and contracting information, as listed above, as well as for other reasonable purposes and as required by law.

Non- Great Dane User Registrations


This section applies to Non-Great Dane Users only.


Non-Great Dane User Registrations are those individuals that are not Great Dane employees or Great Dane Temporary Workers, and have an approved registration in this system.


This LMS may include information regarding your employer for the purposes of training evaluations and authorizations. The information, resources and training contained within this site in no way displace or replace training or policy or any other lawful requirement of your employer.


The Content on this site that you have intended access to are intended for reference, training and evaluation only. Use of the system includes access and requirements to resources, training, performance scores, and marks, records of attendance or activity completion for various courses, certificates, programs, and evaluations and other such materials or tests included in the Content.


Great Dane is not obliged in any way to ensure that you complete or meet any requirements set out as either a part of this LMS or any other Content that Great Dane may have in place. Great Dane reserves the right to modify learner status based on data collected from this site and other sources at their discretion.


Great Dane uses records from this site and other sources to:

  • determine status as a learner,
  • provide records to you and your employer to indicate learner training,
  • evaluate performance for learners

Completion of training, courses or any other criteria in this system do not assure, promise or guarantee any temporary employee or applicant or any individual a position working as an employee of Great Dane in any way.

Certificates & Qualifications

Great Dane has established formally documented programs, certifications and qualifications under which individuals may receive training and/or take examinations and/or evaluations to demonstrate competence relating to one or more Great Dane products or solutions.


Requisite training and successful completion of the applicable examination(s) and evaluations to obtain the credential related to a specific Great Dane product or solution are hereafter referred to as the “Certification Requirements” with respect to that certification credential.


Certain programs, certifications and qualifications such as the Aftermarket Certified Technician Program require that individuals are approved registrants to be eligible for participation and/or certification. Access to, or participation in any component(s) of these programs, certifications or qualifications through the Content does not imply any association with those programs, certifications or qualifications.


Individuals who successfully complete the Certification Requirements with respect to the certification credential for a specific Great Dane product or solution will be eligible to become Great Dane Certified with respect to that product or solution.


Great Dane certified status is an indicator that a user has completed and met the requirements of defined theory education, on-the-job experience, and/or examination requirement(s); or any combination of these; at a specific point in time.


Certification is not a guarantee or assurance of the on-going competence or ability of any particular individual. Further, given the rapid changes in the field, Great Dane cannot guarantee that the examination and other certification materials will at all times reflect knowledge, technologies or methods most current.


Great Dane disclaims all liability for any losses, claims, damages, suits, actions personal injury, property or other damages of any nature whatsoever, whether special, direct, indirect, consequential or compensatory; directly or indirectly resulting from the certification program; or from acts or omissions in the program; or from acts or omissions of any person who has been certified by Great Dane. Each participant shall fully indemnify, defend and hold harmless Great Dane, its employees, affiliates and related persons from and against all such claims.


In conducting the programs, certification and qualifications, including issuing certifications, Great Dane is not undertaking to render professional or other services for or on behalf of any person or entity, nor is Great Dane undertaking to perform any duty owed by any person or entity to someone else. Anyone using the services of a person who has been certified should rely on his or her own independent judgment or, as appropriate, seek the advice of a competent professional in determining the exercise of reasonable care in any given circumstances.

OSHA

The Content does not alter or determine compliance responsibilities which are set forth in OSHA standards, and the Occupational Safety and Health Act. The Content is intended to provide a generic, non-exhaustive overview of particular Great Dane standards-related topics. The Content does not itself alter or determine compliance responsibilities, which are set forth in OSHA standards and the Occupational Safety and Health Act. Because interpretations and enforcement policy may change over time and for additional guidance on OSHA compliance requirements, the User should consult current and administrative interpretations and decisions by the Occupational Safety and Health Review Commission and the courts.
